**US Senators Question TCS Over Hiring Practices and H-1B Worker Policies**

Tata Consultancy Services (TCS), India’s largest IT services company, has come under scrutiny from U.S. Senators regarding its hiring practices in the United States. In a recent letter addressed to TCS CEO K Krithivasan, Senate Judiciary Committee Chairman Charles Grassley and Ranking Member Richard Durbin raised several concerns about the company’s use of H-1B visas and the impact on American workers.

**Concerns Over Layoffs and H-1B Petitions**

The Senators highlighted TCS’s recent announcement of laying off more than 12,000 employees globally, including American workers. Notably, nearly 60 employees from the Jacksonville office were laid off. At the same time, the company has been filing thousands of H-1B visa petitions to bring in foreign tech workers. In fiscal year 2025 alone, TCS received approval for 5,505 H-1B hires, making it the second-largest employer of newly approved H-1B visa beneficiaries in the U.S.

**Questions on Workforce Practices and Age Discrimination**

The letter expressed skepticism about TCS’s claim that it cannot find qualified American technology workers. The Senators also pointed out that TCS is currently under investigation by the Equal Employment Opportunity Commission (EEOC) for alleged age discrimination—specifically firing older American employees in favor of younger South-Asian H-1B visa holders. The letter warned that “TCS is doing itself no favors by replacing Americans with H-1Bs while this investigation is ongoing.”

**Nine Key Questions for TCS**

The Senators have requested a detailed response from TCS by October 10, 2025, addressing nine specific questions, including:

– Why is TCS hiring foreign tech workers when many American tech workers have recently been laid off?
– Did the company make a “good faith effort” to hire American workers before filing H-1B visa petitions?
– Has TCS displaced American employees with H-1B visa holders?
– Does TCS provide wage parity and equal benefits to H-1B workers compared to American employees with similar qualifications?
– Are H-1B recruitment ads listed separately from general hiring advertisements, potentially reducing transparency?
– Does TCS outsource hiring to contractors or staffing firms that place foreign workers within the organization?

**Calls for Greater Transparency**

The Senators emphasized the need for transparency in TCS’s hiring practices and expressed concern over the possible displacement of American workers by foreign H-1B employees. They seek clarity on how the company balances its workforce needs while complying with U.S. labor laws and ensuring fair treatment of all employees.

As the investigation unfolds, TCS’s response will be closely watched by lawmakers, industry insiders, and the broader tech community.
