Mumbai: The special court for Protection of Children from Sexual Offences (POCSO) on Friday directed the Deputy Commissioner of Police (DCP) to file a reply on a plea seeking a further probe against the office-bearers of the Bandra-based Otters Club. This is in connection with a case of alleged sexual assault on a minor boy by a waiter at the club in September 2023.
**About The Case**
The court was hearing arguments presented by advocate Rizwan Merchant, representing the complainant’s father, who is a businessman. The victim was a 7-year-old boy at the time of the alleged incident. The advocate contended that the court should seek a response from the DCP regarding a further investigation to be conducted under his supervision.
The court has now scheduled the next hearing for the coming week.
The complainant had challenged the closure report submitted by the Bandra police against the club’s office-bearers, who were also named in the complaint. It was argued that even after the facts were brought to the managing committee’s attention, they failed to take appropriate action. Consequently, the complainant filed a police complaint demanding prosecution of the office-bearers for their alleged inaction.
Furthermore, the father claimed that the office-bearers attempted to arm-twist him and assured him that the matter would be referred to the Prevention of Sexual Harassment (POSH) committee. However, since the case involved child sexual harassment, it could not be addressed by the POSH committee, he argued.
